ÖVP-Kurz with attacks on judiciary in the footsteps of Poland and Hungary – Kurz has to stop his attacks on judiciary immediately
Vienna (OTS / SK) – SPÖ federal director Christian Deutsch reiterated his criticism of Chancellor Kurz’s attacks on the Austrian judiciary today, Friday. “According to reports, ÖVP-Kurz not only attacked the economic and corruption prosecutor’s office in his now infamous background discussion, but also shot the Constitutional Court head-on. Kurz’s approach is an incredible derailment that has no place in a developed constitutional state, ”said Deutsch, who emphasized in the direction of the Federal Chancellor:“ Hands off the judiciary, Mr. Kurz! ”. ****
“Briefly, his close relationship with the Visegrad states of Poland and Hungary is now also shown by the fact that he wants to use these authoritarian governed states, where pressure has been exerted on the judiciary for years, as a model for an apparently planned restructuring of our judicial system. Just recently, a “reform” of the judiciary was to be carried out in Poland, in which politically unpopular because independent judges should be removed from their functions. The Polish judiciary defended itself against this and was immediately supported by the European Court of Justice. The corresponding law has been repealed. The fact that the Austrian judiciary is to be curbed by Kurz must raise the alarm bells for all democrats, ”Deutsch told the SPÖ press service.
“The fact that the principle of the separation of powers is a central component of our federal constitution in Austria should obviously not bother Mr. Kurz,” said Deutsch. In this context, he pointed out that in order to avoid any doubts in 2008, the public prosecutor’s authorities were referred to in Article 90a of the Federal Constitution as “organs of justice” and are therefore completely beyond the reach of politics – with the exception of the Minister of Justice as the top authority to issue instructions. “Students usually have this basic legal knowledge,” says Deutsch.
According to Deutsch, Chancellor Kurz is apparently trying to enforce his blunt threats to the economic and corruption prosecutor’s office in a background discussion. “I expect Kurz to immediately refrain from the planned repression,” said Deutsch. “We will take a very close look at what other parts of the federal government are planning to do here.
