Justice – Frankfurt am Main – Appeal of ex-Awo managing director rejected – Panorama

Frankfurt / Main (dpa / lhe) – In the legal dispute about his termination without notice, the former managing director of the Frankfurt workers welfare organization suffered another defeat. The Hessian State Labor Court (LAG) rejected appeals by the former Awo managing director Jürgen Richter against the termination without notice and against the rejection of payment claims, as the court announced on Thursday in Frankfurt. The state labor court thus confirmed the corresponding judgments of the labor court in Frankfurt.

In the opinion of the chamber, the district association of workers’ welfare effectively terminated the employment relationship on January 28, 2020. The allegation is justified that Richter endangered the assets of the district association in 2015. As the sole managing director, he wanted to arrange for a fee to be paid, although he knew that the fee claim was not justified. In doing so, he had violated his obligation not to jeopardize the economic interests of the district association.

The signatories of the termination were also entitled as board members to act for the district association. The association also kept the deadline within which an extraordinary termination must be declared. Since the employment relationship ended on the following day, the terminations that were later declared to the judge are irrelevant. The appeal to the Federal Labor Court was not allowed, it said in the message. The judgments are not yet final.

Richter’s lawyer Bernhard Lorenz told the German Press Agency that he thought the decision was wrong and saw contradictions in both the first-instance judgment and the Awo’s lecture. It is therefore likely that he will file a non-admission complaint.

In contrast, the CEO of Frankfurt Awo, Steffen Krollmann, said: “We are pleased that Jürgen Richter was unsuccessful in his appeal and that the court upheld the first-instance judgments.” This is an important message to the members, employees and supporters and confirms the Awo on their course. “We are on the right track and will push ahead with the legal processing with all consistency.”

At the Frankfurter Awo, millions of euros in damage are said to have arisen due to excessive salaries and luxury company cars.
