The case dates back to the end of March 2019. The mayor of Dijon, François Rebsamen, then takes a municipal decree to prohibit the use of pesticides containing glyphosate throughout the municipal territory of the city. In the process, the mayor of the neighboring town of Chenôve, Thierry Falconnet, decides to take the same type of decree for his municipality, but in September 2019, the prefect of Côte-d’Or decides to attack these decisions before the administrative court of Dijon.
Upon receipt of the mail, the mayor of Dijon explains that if he hears “the need for the state to uphold the laws of our country “, François Rebsamen ensures that he will know “take his responsibilities”, that it will maintain its decree. Which was the case.
Two years later, the justice cancels the municipal decrees
The hearing at the Dijon administrative court took place last December and it has just rendered its decision. Our colleagues from Good public explain that the judges considered in particular that if the mayors may take, for their municipality, the general police measures necessary for good order, public safety, security and sanitation, they can not “legally use this competence to enact regulations relating to the general conditions of use of pharmaceutical products that it is up to the State authorities alone to take.“The decrees are therefore canceled by the courts, which the Dijon town hall confirms to us.
