Title: Access to health care and compliance with health instructions in times of pandemic: two independent concepts
Résumé
In the United States, bioethicist Arthur L. Caplan, along with three colleagues, said in a text published in the PennLive Patriot-News in May 2020 that anyone with COVID-19 who did not follow the public health guidelines regarding mask wear or social distancing or who is believed to be responsible for a COVID-19 outbreak should volunteer for treatment last. To do so, they rely on the principle of the famous philosopher John Stuart Mill that the expression of freedom can not cause harm to others. Although one can understand the arguments
evoked by Caplan and his colleagues, this position cannot be applied in the Quebec context, for legal, ethical and public health reasons.
