Junta de Andalucía Launches Annual Inspection Plan to Combat Abusive Clauses in Mortgage Loans

These actions are part of the Inspection Plan that the Junta de Andalucía launches annually.

The Health and Family Counselingthrough the Provincial Consumer Servicesis developing an inspection campaign to verify the existence of abusive clauses in the deeds of mortgage loans already formalizedin order to guarantee the effective protection, recognition and realization of the legitimate economic and social interests of consumers.

The clauses on which this campaign is going to pay special attention are those related to the advanced expiration datethe imposition of mortgage expensesthose relating to commissions (study, subrogation, management of non-payments and claims for debt positions, early amortization, etc.) and insurance. Likewise, other abusive clauses present in mortgage deeds will be reviewed, such as default interest, limitation of the free disposal of the mortgaged asset, waiver of the debtor to be notified of the assignment of the credit or rounding up.

Specifically, through this campaign a total of 36 social reasonscorresponding to lending entities, both credit and other types, to each of which the Provincial Consumer Services They will require 12 deeds of already formalized mortgage loans, for the purposes of verification actions.

The controls to verify the existence of abusive clauses in the loan and mortgage credit contracts for the purchase of housing 2019 are part of the Inspection Plan that the General Directorate of Consumer Affairs develops this year. This plan provides for the realization of 26 campaigns in different sectors, including approximately 9,000 controls.

The largest number of inspections will take place in the service sectorwhere more than 5,000 actions within the framework of 11 different campaigns, aimed at the control of various areas of the market that affect a large number of consumers and users, or in which more intense protection of their rights is necessary: ​​basic control of food and non-food establishments, supply markets and supply companies of services, remote contracting through websites, sales, housing, establishments dedicated to catering, advertising and unfair commercial practices, banking sector to control abusive clauses, telecommunications, airlines, vehicle repair workshops and training academies training.
