The resolution of the European Parliament on abortion is an unprecedented attempt to interfere with the internal systemic issues of the Republic of Poland, not covered by the European treaties, believes Julia Przyłębska, President of the Constitutional Tribunal. In a vote on Thursday, the European Parliament adopted a resolution concerning the “de facto ban on the right to abortion in Poland”. It was prepared by five political groups: the European People’s Party, Socialists and Democrats, Renew Europe, Greens and GUE. The non-legally binding resolution was supported by 455 MEPs, 145 were against and 71 abstained. In a resolution, the EP “strongly condemned” the ruling of the Constitutional Court on abortion in Poland, considering that “this ruling endangers the health and life of women”.

The European Union does not have the power to shape the decisions of the Constitutional Tribunal of a member state, as well as to verify the legality of the election of its judges.. It is an extra-trait usurpation of competences. I am amazed that Members of the European Parliament are not aware of this fact – emphasized the president of the Constitutional Tribunal.

As she stated, the judgment of the Constitutional Tribunal was issued in accordance with the law in force in Poland by judges elected without violating any legal norms. There is no factual and legal justification for questioning the decision and the status of judges – emphasized the president of the Constitutional Tribunal.

In their resolution, MEPs attack one of the foundations of a democratic state ruled by law, the independence of the judiciary. Moreover, the Constitutional Tribunal adjudicated solely on the eugenic ground justifying termination of pregnancy. The Act on family planning, protection of the human fetus and conditions for the admissibility of termination of pregnancy still allows for the possibility of termination of pregnancy if it constitutes a threat to the life and health of a woman, and there is a justified suspicion that pregnancy is the result of a prohibited act, including rape, which MEPs did not notice. Therefore, the accusations against the decision that it deprives a woman of the right to choose when their life or health are at risk are completely unfounded. – notes the President of the Court.

She emphasized that “the Constitution of the Republic of Poland provides everyone with the legal protection of life and health, which was confirmed by the Constitutional Tribunal in its ruling”.

The European Union is a community of values. So I remind you all of Art. 3 of the Treaty on European Union, stating that, in accordance with the principle of sincere cooperation, the Union and the Member States respect each other and I appeal to all Members of the European Parliament to respect and to stop discrediting the Republic of Poland by undermining the legality of its constitutional organs, including the Constitutional Tribunal – Przyłębska said.
