Judicial Reform and Priorities: “Autopsy” of the Model of Exploitation of Judicial Power

The co-chairman of “We continue the change-Democratic Bulgaria” Hristo Ivanov made it clear that his party “Yes, Bulgaria” may revise the degree of support to “the next edition of the rotation formula”, if he does not receive guarantees for the implementation of judicial reform and priorities in the next 9 months.

In an interview with BNR, Ivanov expressed ambitious expectations for the temporary parliamentary commission to investigate the facts of the presence of unregulated influence in the justice system by the shot Martin Bojanov-Notarius and the group around him. This commission must perform an “autopsy” not just of the specific criminal case, but also of the institutional context that made it possible, said the PP-DB co-chairman.


He insisted on legal changes that would enable the deputies from the commission to obtain from the investigators the materials that they usually hide as “investigative secret”.


The initiative for the formation of the commission was taken by the candidate for the leader of the DPS, Delyan Peevski, sanctioned under “Magnistki” for “significant corruption” and known for his influence on the services and the judiciary, especially the prosecutor’s office.

“The murder of Martin Bojanov and what is currently being hinted at around his figure, around his activity, there is every reason to expect that it can and should become a a moment of truth in general for the whole model of influence, of exploitation against the law, of judicial power. It is very important that the National Assembly shows will and illuminates all aspects of this case”commented Hristo Ivanov in an interview for the program “Nedelya 150”.


According to him, the question is not simply who killed the Notary, but the whole pattern of his functioning must be examined:

“Here, a much larger autopsy must be done, not just on the corpse, on the individual criminal structure, but on everything, as an institutional context, that made this possible”.

What the “investigative secret” hides


According to him, this “autopsy” should be done by the parliament. This is a fundamental issue that has its political dimensions, the deputy emphasized.

Hristo Ivanov reminded that the experience of the work of similar commissions has shown that they encounter certain limitations. That is why he believes that the legislative framework that can overcome these limitations should be considered:

“Very carefully, but we need to open the topic of this – can we create specific criteria by which materials that are an object and can be covered in the form of an investigative secret, however, in the presence of an overriding public interest, can become public. A change in the legislation in this regard should be discussed so that the parliament can more fully do its work”.

“The topic is not a domestic issue, it is not a matter of someone’s personal whim, but a legitimate structural interest in finding the right balance in the next edition of the rotational government – to construct the foreign policy communication in such a way that it does not lead to additional tensions in the structure. At the same time, of course, Mrs. Gabriel’s interest in continuing her successful job as foreign minister is absolutely objective and legitimate.”

The co-chairman of PP-DB recommended the question should be left to Academician Nikolay Denkov and Maria Gabriel.

“Yes, Bulgaria” can reconsider its commitment to the assembly
