Judicial Commission (KY) summoned the Chairman of the Central Jakarta District Court and the panel of judges who tried the Prima Party lawsuit. The summons was made related to the decision, one of which ordered the postponement of the election.
“Today the Judicial Commission summoned the Chairman of the Central Jakarta District Court for questioning regarding Prima’s decision against the General Elections Commission. This civil case is often referred to as a decision to postpone the election,” KY spokesman Miko Ginting told reporters, Monday (29/5/2023).
Miko said the Head of the Central Jakarta District Court could not attend today. He said the Head of the Central Jakarta District Court would be summoned again.
Meanwhile, the panel of judges judging Prima’s lawsuit will be examined tomorrow. Miko hopes that the panel of judges can attend tomorrow.
“Summoning and extracting information was carried out in the context of tracing whether or not there was a violation of the Code of Ethics and Code of Conduct for Judges (KEPPH), an area which is the domain of Judicial Commission,” he said.
For information, the Central Jakarta District Court’s decision originated with a lawsuit filed by Prima on December 8, 2022. In its lawsuit, the Prima Party felt it was disadvantaged by the KPU in verifying the administration of political parties as stipulated in the Recapitulation of Verification Results of Administration of Political Parties for Candidates for the 2024 Election.
Prima Party was declared as Not Qualifying (TMS) and could not participate in factual verification. The Prima Party admitted that it experienced immaterial losses that affected its members throughout Indonesia due to the KPU’s actions.
The Prima Party also asked the Central Jakarta District Court to punish the KPU not to carry out the remaining stages of the 2024 Election for approximately 2 years, 4 months and 7 days since the decision was read. As a result, the judge granted all of the Prima Party’s lawsuit.
The judge stated that the KPU had committed an unlawful act and punished him not to carry out the remaining stages of the 2024 General Election. The KPU then submitted an appeal.
As a result, the DKI Jakarta High Court granted the KPU RI’s appeal regarding the decision of the Central Jakarta District Court which postponed the 2024 election stages. The appeal decision was annulled and the election stage was not postponed.
“The court accepted the appeal of the appellant/defendant, annulled the decision of the Central Jakarta district court number 757/pdtg/2022 PN Central Jakarta dated March 2, 2023 which the appeal was requested for,” said chief judge Sugeng Riyono when reading out the appeal decision at PT DKI Jakarta, Tuesday (11/4).
The judge also stated that the Central Jakarta District Court had no authority to try this case. The Prima Party lawsuit is also unacceptable.
Prima is now fighting again. The Prima Party filed an appeal to the Supreme Court.
