Man Admits to Raping and Impregnating 10-Year-Old Girl, Sentenced to 25-30 Years in Prison
A little over a year after a 10-year-old girl from Columbus, Ohio made national headlines for having to travel to Indiana for an abortion, the man responsible for raping and impregnating her has pleaded guilty to his crimes. Gerson Fuentes, a 28-year-old Guatemalan national, admitted to two counts of rape in Franklin County Common Pleas Court.
Assistant Franklin County Prosecutor Dan Meyer revealed that Fuentes’ guilty plea was part of a plea deal that included a recommended sentence of life in prison with the possibility of parole after a minimum of 25 years. However, Judge Julie Lynch was not obligated to follow this recommendation.
Despite the severity of the crime, Lynch stated that the girl’s family had “begged” her to agree to the recommended sentence. She acknowledged the difficulty of the decision, as the court considers this offense to be one of the worst. Ultimately, Lynch sentenced Fuentes to life in prison with the possibility of parole in 25 to 30 years. After serving his sentence, Fuentes may also face deportation and will be required to register as a Tier III sex offender for life.
DNA evidence confirmed that Fuentes, who was identified as the boyfriend of the girl’s mother, was responsible for impregnating her. Fuentes’ defense attorney, Zachary Olah, stated that his client had been cooperative throughout the investigation and was eager to resolve the case.
The young girl’s case became a focal point in the state and national abortion debate after the U.S. Supreme Court overturned Roe v. Wade in June 2022. Due to Ohio’s ban on abortions after six weeks, the girl had to travel to Indiana to obtain the procedure. The case sparked discussions among Democrats and President Joe Biden about the importance of protecting abortion access, while some Republican lawmakers and officials questioned the veracity of the girl’s story.
The evidence against Fuentes included a positive pregnancy test conducted by the girl’s primary care doctor, as well as DNA analysis of the “product of conception” retrieved after the abortion. Fuentes admitted to the rapes during a police interview and subsequent DNA swab.
This case shed light on the prevalence of child sexual assault and abuse. An investigation by The Dispatch and the Cincinnati Enquirer revealed that over 22,000 children were listed as sexual violence victims in Ohio law enforcement reports between 2017 and 2021, with more than 12,000 victims being 12 years old or younger.
Currently, Ohio’s ban on abortions after six weeks is on hold, allowing individuals to legally obtain an abortion before 22 weeks into pregnancy. However, an appeal is pending with the Ohio Supreme Court regarding the restrictions imposed by the Republican-controlled General Assembly.
The victim and her family were not present in court during Fuentes’ sentencing, and prosecutors declined to comment further on the case.
