Judge: publication about crown witness Nabil B. may continue

According to the AD, the piece is quoted from app messages that Nabil B. exchanged with his family in recent years.

The summary proceedings started tonight behind closed doors at 8 p.m., because information that was discussed could potentially be harmful to the freedom of the key witness, a spokesperson said.

One of the reporters of the AD would have had access to thousands of messages exchanged between the key witness, family members and his girlfriend.

According to the newspaper, the app traffic would shed new light on the role played by the crown witness in the Marengo trial. Marengo revolves around a series of underworld murders and plans, attempts and preparations.

Schouten, who is assisting Nabil B. in the trial, stated that a number of matters in the intended publication are ‘tendentious, false and/or incorrect’. writes the AD.

Freedom of speech

“The importance of freedom of expression outweighs the importance of protecting the honor and reputation of claimants,” the judge said. According to him, these are serious allegations against the crown witness. A date in the article will be adjusted and a sentence will be reworded in consultation between Schouten and the newspaper.

Schouten conducted the summary proceedings on behalf of B. and his sister. The counselor also demands a penalty if the ADR Nieuwsmedia nevertheless proceed to publication.
