The judge of the Court of First Instance and Instruction number five of Puerto del Rosario, María Teresa del Pino Hernández Andrea, has fully upheld the lawsuit filed by a couple from Corralejo, legitimate owners of a house registered by the plot of the case of the old town of the location.
Thus, it orders that the Corralejo Property Registry proceed with the registry rectification, configuring the property as a new independent farm, accommodating it to its real situation and not to that created artificially by José Manuel Jiménez del Valle, considered the ringleader of the plot.
In this case, it is a house owned by Inmaculada Fuentes Curbelo and Valeriano Umpiérrez González, located on La Milagrosa street. On it, Del Valle, through one of his companies, Delval Internacional, carried out an urban operation, “as if it were a plot that he had acquired for the purchase of a larger registered property in the town of Corralejo, whose surface and location were unknown.
However, “it was a lifelong home, built by the parents and in-laws of the current owners, intending, with this, to take away their houses, as they had already tried with more than numerous houses of residents of the town.”
The judge points out that Jiménez del Valle knew, because he was a resident of Corralejo, that the disputed home was not found within the property that he had purchased from the Plalafusa entity at the time, like many others belonging to other residents of Casco de Corralejo.
The modus operandi consisted of segregating them as independent farms, as if they were plots, in order to dispose of them, on occasions, “selling the property to themselves (from one of their companies to another of their companies) or to third parties or mortgaging them, obtaining a profit economic, product of the sale or disposition of the requested mortgage credit, credit that, later, stopped attending ”, indicates the neighborhood association.
