Roxeanne Hazes has taken her mother Rachel to court. The singer wants Rachel to no longer call herself the heir of André Hazes. According to Roxeanne, her mother has no such right at all. Today, the Central Netherlands District Court will issue a written judgment in the summary proceedings.
André Hazes had a provision in his will before his death: if he and Rachel were divorced, she would not see a penny. Roxeanne Hazes’ lawyers stated in court two weeks ago that the divorce proceedings had already started when André Hazes died.
The procedure was only withdrawn on December 27, 2004, according to various documents. André Hazes died three months earlier, on September 23, 2004. This means that Roxeanne and her brother André Jr. are the only heirs.
According to Rachel Hazes’ lawyers, this is not true. Rachel and André Hazes had already decided to end the divorce proceedings.
Rachel Hazes also concealed certain goods, as she was accused in court. She allegedly lied about the existence of a family holiday home. And she would have used the intellectual property rights that concern the music and image of Hazes senior. Roxeanne states that her mother was not entitled to this at all and that she suffered financial and reputational damage as a result.
Rachel Hazes’ lawyer argued in court that Roxeanne and André Jr. are not entitled to income from intellectual property. Those rights have been assigned to Rachel, according to her lawyer, it can be concluded from the documents.
Roxeanne Hazes did not bring the case on her own. Robert Israel, who was a senior willary administrator, is also involved. It was Hazes senior’s wish that he would make the decisions about the inheritance. Israel now says he couldn’t do this job properly because Rachel was hiding things.
Roxeanne Hazes not only demands that her mother can no longer call herself an heir. She also wants Rachel to stop making agreements when it comes to her father’s music and image. In addition, she wants to be able to view all documents about the inheritance. According to her lawyers, that has not yet happened.
The singer actually hoped to get out of court with her mother. She also would have preferred that the media did not know about the case. “Unfortunately, the judge has to make the decision, no matter how much effort has been made to prevent this,” said her spokesman Bernard Tomlow.
Rachel also did not like the lawsuit. Her lawyer states that Roxeanne has been offered several times to view all documents at an accountant’s office. “If Roxeanne had taken up that offer, we wouldn’t be here.”
Roxeanne Hazes herself was not present in court in Utrecht on February 9. In a statement, she said that she has decided to be absent because of her mental health. Rachel was present, but did not speak to the press.
