In this case, the judge is expanding the current rules to specifically address past abuse as well. That is, specifically that abuse which the new legislation does something about.

In short, the judge says: the new rules also apply to old cases, because otherwise unfair behavior will be rewarded. That seems very fair to me.

*If I understand correctly, your patent used to count from the date of approval, (but you had protection from the moment of application as ‘first’) and nowadays from the moment of application. The reason was because applicants trained the date of approval as much as possible, hoping to lure others into a patent trap. That’s the exact opposite of what the patent system is trying to achieve!
