Judge bans off-road event in Ruinen

The off-road event of the motorcycle association MC’80 in Ruinen is not allowed to take place on Sunday. That is what the judge decided today. The municipality of De Wolden has not looked sufficiently at the damage that this event can have on nature. And there is no consultation procedure for this.

The Meppel Nature Conservation Watch Foundation filed a lawsuit against the municipality. He should have been heard as an objector before the permit was granted. And that didn’t happen.

This defect cannot be repaired before Sunday, the judge said and he canceled this event for now. This to the great disappointment of the motorcycle association. “We are left with a huge cost item due to failing government policy,” said Bas Hof of MC’80. This year the 38th tour would be held around Ruinen. According to Hof, conservationists are now given ammunition to stop such events. Geert Starre of the Nature Conservation Watch does feel this accusation. “It is the government that is causing this chaos. This disappointment could have been avoided if we had been heard before the decision-making process.”

Hell for nesting birds

The conservation organization argued in court that 700 dirt bikes in a wooded area is hell for nesting birds and awakening amphibians. “They live exactly where they would be driven and will be driven to pieces,” said Starre. He did not get to the substantive arguments. The judge was deeply disturbed by the late decision-making of the municipality. The permit was granted shortly before the event. An objection procedure is then no longer possible and the case ends up on the court’s plate with steam and boiling water. “Why so late?” he asked the spokespersons of the municipality. They blamed the corona measures.

Consequences for the next event?

The ban on the tour in Ruinen may have consequences for a subsequent off-road event. This is organized by De Antrappers in de Wijk and will be held a week later. Then a thousand riders appear at the start. According to Starre, the license was granted in a similar way. According to Starre, there is also no consultation procedure in this case. According to the organization, the province and the municipalities do not comply with the law in these cases. The request for a preliminary injunction (injunction proceedings) has already been submitted. It is not yet known when that case will be heard.
