Because he published a crime scene photo of the massacre of a Jewish family on Facebook, a refugee from Syria was on trial on Monday.
The Palestinian had added a red heart emoji to the picture and the words “Blessed Festival of Sacrifice” in Arabic. When he left the courtroom, he cheekily showed the finger!
Tiergarten District Court. Accused: Musaab AA (24). Born in Syria. School up to 11th grade. Summer 2015 across the Western Balkans to Europe. July 31, 2015 asylum application in Germany. Stay until December 15, 2019, subsidiary protection.
Two entries in the German criminal record. March 2019 one year and three months probation (dangerous bodily harm, coercion). December 2019 fine for an anti-Israeli graffiti (damage to property, 225 euros).
The charge is read out by a senior public prosecutor from the “Central Office for Hate Crime”. This was set up in September 2020 to “prosecute prejudice-motivated crimes more effectively”. The reason for this is that racism, anti-Semitism and other forms of group-related enmity are always motives for committing crimes.
“This not only harms those affected, but also leads to collective intimidation of minorities in public spaces,” says the Berlin Public Prosecutor’s Office.
The allegation against the Syria refugee: He publicly approved of murder. On July 21, 2017, he published a photo on his Facebook account of the massacre of a Jewish settler family in the West Bank (three dead, one seriously injured). The perpetrator – a Palestinian – was later sentenced to four life imprisonment.
When the defendant was investigated in the summer of 2019, his cell phone was seized. In it, the criminal investigation officers came across the now accused Facebook entry from 2017.
The accused is silent. His defense attorney is demanding an acquittal.

The judge sentenced him for approving crimes and disturbing the public peace. The penalty: a warning! “The photo shows a blood-flooded kitchen with a shoe,” says the judge. “People were slaughtered there. Anyone who calls this a festival of sacrifice mocks the victims. “
The warning is issued in accordance with youth criminal law because the defendant was 20 years and three months old at the time of the crime and not yet of legal age.
