The Court of Competition and Consumer Protection upheld a fine of over PLN 60 million for Jeronimo Martins Polska. The justification emphasized that misleading consumers may concern product features – including marking with the country of origin, and full and reliable information about the products offered is the obligation of the entrepreneur and the inalienable right of the consumer.

Biedronka misled consumers
As reported by UOKiK in April 2021, the proceedings were initiated after consumers complained about incorrect indication of the country of origin of vegetables and fruits, which was confirmed by the results of the inspection of the Trade Inspection.
– Reliable information about the products offered is the basic obligation of the entrepreneur and the inalienable right of the consumer. Meanwhile, in Biedronka stores, consumers who wanted to buy Polish potatoes, tomatoes or apples were often misled. Our investigation showed that in many cases the information on the notices differed from that on the bulk packaging or in the delivery documents. These breaches were systemic and long-lasting. That is why I imposed a fine of over PLN 60 million on Jeronimo Martins Polska, said Tomasz Chróstny, President of UOKiK.
As stated in the communiqué, for example, the sign next to the stand read “Polska”, although in fact it was garlic sold on October 15, 2019 in Biedronka in Łódź came from Spain, potatoes offered on February 19, 2020 in Radymno (Podkarpackie Province) – from Francesavoy cabbage sold on February 19, 2020 in Kołobrzeg – from France, celery offered on May 12, 2020 by a discount store in Koszalin – from the Netherlands, pears available on February 24, 2021 in Biedronka in Katowice – from the Netherlands, and shallots, which could be purchased on February 24, 2021 in a store in Bydgoszcz – from France.
