Jakarta Court Sentences Mario Dandy to 12 Years in Prison, Appeals Filed

Match Mario Dandy Satriyo in the case of abuse against David Ozora hasn’t stopped yet. Mario Dandy has now officially filed an appeal against the 12 year prison sentence.

Mario Dandy was initially sentenced to 12 years in prison at the first instance of the South Jakarta District Court. The judge’s decision is the same as the demands presented by the prosecutor. The judge stated that Mario was proven to have committed serious abuse against David.

“Sentenced Mario Dandy to 12 years in prison,” said presiding judge Alimin Ribut Sudjono at the South Jakarta District Court, Thursday (7/9/2023).

Mario Dandy was found guilty of violating Article 355 paragraph (1) of the Criminal Code in conjunction with Article 55 paragraph (1) 1 of the Criminal Code. The judge stated that Mario Dandy had planned the abuse of David Ozora.

The judge stated that there was no excuse or justification for Mario Dandy’s actions. The judge said Mario Dandy must be held accountable for his actions.

“The defendant Mario Dandy can be held criminally responsible,” said the judge. The judge said there were no mitigating circumstances for Mario Dandy.

Apart from being sentenced to corporal punishment, Mario Dandy was also asked by the judge to pay restitution or compensation worth IDR 25 billion.

“Pay restitution of IDR 25 billion,” said the judge.

The judge stated that he did not agree with the calculation of restitution from LPSK which was included in the prosecutor’s demands, namely Rp. 120 billion. According to the judge, reasonable restitution is IDR 25 billion.

The restitution consists of compensation for the cost of renting a place to live while David was undergoing treatment in hospital, life support guarantees, care guarantees and other things related to the legal process. The judge also considered replacing restitution with a prison sentence as inappropriate.

The judge said the sentence for paying restitution continues to stick with Mario Dandy. The judge also said David could file a civil lawsuit against Mario Dandy regarding this restitution.

According to the judge, the Rubicon car driven by Mario Dandy can be auctioned. The results can be used to pay restitution.
