Ivancheva’s defense seeks pardon – Crimes – Bulgaria – NOVA News

Desislava Ivancheva to be pardoned. This is what she asked for her defense after yesterday the former mayor of “Mladost” ended up in jail. The court finally ruled that Ivancheva and her deputy Bilyana Petrova should serve six-year and five-year sentences, respectively.

The motivations of the Supreme Court are now clear. According to the magistrates, the former mayor’s behavior during the requests and bribes received was “willful and selfish”. The court decided to further reduce the sentences of the two women due to the longer duration of their detention and the length of the trial.

Several countries are seeking state pardons for Ivancheva and Petrova. The former mayor’s lawyer explained that such a request had already been presented to the presidential institute. The citizens who have been collecting signatures since yesterday should also do it.

State pardons are granted only in exceptional cases, and the right to decide who will receive them has been delegated to Vice-President Iliana Yotova.

Hours after Desislava Ivancheva and Bilyana Petrova were imprisoned, a request for state clemency arrived.

“I have no expectations, but being a lawyer and a citizen – I insist.” We citizens continue to lose the battle for justice, so once again we citizens ask Ivancheva and Petrova for pardons,” said lawyer Nikolay Khadzhigenov.

According to the former mayor’s defense, there are a number of reasons for his pardon.

“The whole world knows about the Ivancheva case. It served as edification,” Hadzhigenov said. “This is an amazing method and is very rarely used. I have never used it myself, but the time has come when this has to be used. When justice doesn’t work, the only thing that can be done is this” Hadzhigenov said.

The pardon leads to the unconditional release of the convicted person – in whole or in part from serving the imposed sentence, says Associate Nataliya Kiselova. And it is applicable from the moment of entry into force of the sentence.

“For each individual case, the reasons for granting a superior pardon are different. In this sense it cannot be said that all women mothers can have a reason. They, of course, have the right to ask, but the vice president is not obliged to meet their demand,” said the assoc. Nataliya Kiselova, professor of constitutional law.

There are no hard deadlines for the Vice President’s decision.

“There are no deadlines after the application has been submitted, either by the convict himself or by his family members. A commission will examine the case and may suggest to the vice president, who has been assigned authority, to evaluate how to proceed”, explained Prof. Kiselova.

In front of NOVA, Vice President Iliyana Yotova succinctly replied to Ivancheva’s pardon.

“When the application is submitted, as required by law, and the signature is submitted, we will comment on it,” Yotova said.

From May to August of this year, the Commission for Pardons received 74 applications, according to a reference on the Presidency’s website. 45 of them were recommended to be rejected. There are two clemency proposals still awaiting decision.
