Italy fines Apple Rp170 billion for claiming a waterproof iPhone

The business competition supervisory authority in Italy, Autorità Garante della Concorrenza e del Mercato (AGCM), sent a fine of 10 million euros or around Rp170 billion to multinational technology companies, Apple, on claims for water resistance iPhone.

Through an official statement, AGCM considers Apple’s creative claims regarding iPhone water resistance involving iPhone 8, iPhone 8 Plus, iPhone XR, iPhone XS, iPhone XS Max, iPhone 11, iPhone 11 Pro and iPhone 11 Pro Max misleading.

Apple claims the products are water resistant to a depth of between one and four meters to 30 minutes, depending on the model. MacRumors explained that this ability only applies in certain circumstances such as controlled laboratory tests with pure water.

AGCM criticized Apple for being vague about its water resistance claims. The slap has also become even more spicy for Apple because the company does not cover water damage under the iPhone warranty, even though Apple clearly markets a smartphone product that is waterproof.

AGCM considers it inappropriate to encourage ‘aggressive’ commercial practices highlighting water resistance as a feature, while at the same time the company refuses to provide a warranty if the iPhone model in question is subject to water damage.

The Verge explaining this incident is not the first time that Apple has been in the spotlight of AGCM. Previously, in 2018, Apple was fined 10 million euros for not providing complete information to old iPhone consumers regarding battery management.

The case, known as the ‘batterygate’, led to an apology from Apple which later agreed to pay millions of US dollars in compensation to consumers.
