The right to compensation will be given to individuals – citizens of Ukraine, who are owners, customers of construction, investors of damaged or destroyed real estate, as well as their heirs.

The Verkhovna Rada of Ukraine on Thursday, February 23, supported draft law No. 7198 on the establishment of a compensation mechanism for housing destroyed or damaged during the war. About it informed People’s Deputy Yaroslav Zheleznyak.

It will be practically impossible to receive money for damaged property – instead of them, in particular, either housing certificates or payment for repair work will be provided.

How will compensation be provided?

It is known that the law will be in force for 3 years after the termination or cancellation of martial law “on the territory where such an object is (was)”. Compensation will only be provided for property damaged or destroyed from February 24, 2022.


“The law will not apply to facilities that were in the temporarily occupied territory on the date of the introduction of martial law,” Zheleznyak said.

Compensation itself will be provided only for damaged or destroyed residential property. For example:

  • apartments;
  • other living quarters (rooms in dormitories);
  • estates;
  • garden and country houses;
  • construction objects with supporting and external structures.

There will be no money

As Yaroslav Zheleznyak explained, it is almost impossible to get money for damaged property.

“The owners of destroyed apartments and other residential premises will receive a housing certificate. This is a document confirming the guarantees of the state to finance the purchase of an apartment or other residential premises (including those built in the future) in the amount of a certain amount of money,” the people’s deputy explained.

At the same time, the owners of private houses, according to the deputy, can count on monetary compensation, since they will be given a choice:

  • obtain a housing certificate for the purchase of an apartment or house;
  • or money that will be transferred to an account with a special mode of use to finance construction.

What will be the amount of compensation

The maximum amount of compensation – both monetary and in the form of a housing certificate – has not been established. There will also be no restrictions on:

  • location
  • type;
  • area of ​​new housing, the construction of which will be financed through the certificate.

“If the cost of housing is lower than the amount specified in the certificate, the lost part of the compensation will be paid to the recipient only at the expense of funds received from the Russian Federation to compensate for losses,” Yaroslav Zheleznyak added.
