Where do trading Sundays come from?

On 10 January 2018, the Sejm adopted a resolution to restrict trading on Sundays and public holidays and certain other days. The law defines the rules relating to the restriction of trade and the exercise of trade-related activities in commercial establishments.
254 deputies, including all deputies, voted for the adoption of the ban on Sunday trading Law and Justice and almost the entire club Kukiz15. 23 deputies abstained, mainly from the PSL. Nowoczesna deputies and the majority of PO deputies were against it.

Which shops are open on non-commercial Sundays?

Under the law, the trade ban does not apply to:

  • at liquid service stations,
  • in commercial establishments in which the predominant activity is the flower trade,
  • in pharmacies and pharmacy outlets,
  • in animal treatment facilities,
  • in shops where the main activity is the sale of souvenirs or devotional articles,
  • in commercial establishments where the main activity is the sale of newspapers, public transport tickets, tobacconists, lottery coupons and betting,
  • in post offices in accordance with the law of 23 November 2012 (Postal Law),
  • in commercial establishments in critical infrastructures referred to in the law of 26 April 2007 on crisis management
  • in commercial establishments in hotel establishments,
  • in commercial establishments in establishments operating in the field of culture, sport, education, tourism and leisure,
  • in commercial establishments organized exclusively for the purpose of parties, fairs and other occasional, thematic or sporting and recreational events, even when located within covered markets,
  • in commercial establishments in medical facilities of medical entities and other health facilities intended for people whose health conditions require round-the-clock or around-the-clock health services,
  • in the commercial outlets of railway stations, in sea and port ports and in inland ports and ports – insofar as it relates to the direct service of travellers,
  • in fish first sale centres, in the case of side sales, in fish farms, in commercial establishments involved in the collection of fishery and aquaculture products and in the trade of such products,
  • in airport sales outlets,
  • in free zones,
  • in means of transport, on ships, as well as on marine commercial vessels, aircraft, drilling rigs and other marine hydrotechnical structures,
  • in prison units,
  • in commercial establishments in the premises of military units,
  • in online shops and on online platforms,
  • in the case of trade in goods from vending machines,
  • in the case of the retail trade of agricultural products,
  • in pharmaceutical wholesalers,
  • in the period from 1 June to 30 September of each calendar year in commercial establishments that exclusively sell agricultural machinery and spare parts for such machines,
  • in case of trade in flowers, bouquets, wreaths and candles in cemeteries,
  • in the funeral home,
  • in commercial establishments where the trade is carried out by an entrepreneur who is a natural person only in person, for his own account and for his own account,
  • in bakeries, pastry shops and ice cream shops, where the main activity consists in the sale of bakery and confectionery products,
  • in shops where the main activity is catering,
  • in the field of agri-food wholesale markets managed by commercial law companies whose main activity consists in the rental and management of properties intended for the wholesale of agri-food products,
  • in shops managed by subjects who purchase goods in the area of ​​wholesale agri-food markets,
  • in commercial establishments where only cereals, sugar beets, fruit, vegetables or raw milk are purchased.
