Is it legal to require a COVID certificate: explanation of the Ministry of Health

The requirement to show a COVID certificate in Ukraine is legal. It does not contain medical secrets.

This was stated in Ministry of Health of Ukraine… It is noted that medical secrecy includes referral to a doctor whether a diagnosis is made.

The department referred to article 39-1 of the law “Fundamentals of Ukrainian legislation on healthcare”, the patient has the right to secrecy about his health, the fact of seeking medical help, diagnosis and information obtained during the examination.

“That is, the medical secret contains an appeal to a doctor or a diagnosis, but there is no such information in the documents on vaccination,” the Ministry of Health explained.

They added that law enforcement officers do not violate the law when they demand these documents from citizens during quarantine inspections.

Also, citizens may refuse to be allowed into public institutions if they refuse to provide a COVID certificate.

At the same time, the department recalled that the provision on the availability of a document on vaccination does not apply to visits to banks, gas stations, veterinary stores, pharmacies and all food stores at any level of epidemiological danger.
