Dmytro Lubinets, the Human Rights Commissioner of the Verkhovna Rada of Ukraine, explained whether it is legal to issue subpoenas on the street and in public places.
As reported by Ukrinform, Lubinets reported this in Telegram.
“The issuance of summonses during martial law must be carried out in accordance with the legislation of Ukraine, carried out with respect for the rights and freedoms of citizens, ensuring their protection from illegal interference in personal life and inviolability,” Lubinets emphasized.
It is noted that the place of delivery of the summons is not regulated by the law – it can be a work place, a roadblock, a cafe or a street.
The following have the right to serve a summons: local self-government bodies; managers of enterprises, institutions, organizations, in particular educational institutions; managers of apartment buildings; officials of the district or city recruitment and social support center.
Instead, the citizen has the right to find out who is issuing the summons and to check the credentials of the official.
“Before accepting a subpoena, it is worth carefully reviewing both the certificate and the subpoena itself, checking that the documents are filled out correctly. Do not worry or be ashamed to do it,” the message emphasizes.
