“Arbitrary Freedom Removals”
NGOs and UN experts made pressure on the national Council, to go in the planned law against offenders on the books. “Such interference I’ve never seen”, is annoying, a SVP member of Parliament.
- UN officials blame Switzerland for the planned anti-terror law.
- This provides for house arrest for offenders aged 15.
- On Thursday, the template comes in the national Council.
- Politician of the CVP and the SVP makes the criticism cold.
In the Parliament of the rings comes to stricter terror laws in the hot Phase. In addition to higher penalties for terrorists, the police should be able to act in the future against potential terrorists before a Crime was committed. It is planned, among other things, that even children can be prohibited from 12 years of the contact to a radical environment (see Box below).
The UN report criticized the draft bill
On Thursday, the national Council will decide on the bill. In the run-up to the debate, 80 NGOs have joined forces in the platform “human rights in Switzerland” together, calling on the national Council, the law reject. Five UN special representative obtained two weeks ago in a letter to the Federal Council Position. They demanded that the Swiss government, corrections, the law, the “arbitrary freedom entzügen open” the door.
For example, the UN human act rights Commission is concerned about the application of preventive detention for offenders. A potential danger is not enough to justify a preventive detention. The experts also reject the measures provided for in the case of Minors: This could be stigmatized as “potential terrorists” and “in different social contexts” are discriminated against.
A young man radicalized, and rails against the democracy and the sermon for the establishment of a Theocracy based on the Sharia. He understands that some Muslims respond to attacks against Islam with violence. On the Internet he will contact people who are looking for preachers of violence and hatred. This is the case, the Federal office of police (Fedpol), describes on his Website. Today, the police could not do in such cases is but little, as long as a Person is doing a criminal offence. To change the Minister of justice, Karin Keller-Sutter to the Swiss Federal act on police measures to combat terrorism. Are planned the following measures (from 12 years):
- Reporting requirement: A Person is obliged to report regularly to the police station.
- Contact ban: A Person is prohibited from contact with certain persons, to the spread of terror to curb extremist ideas.
- Travel ban: A Person is forbidden to leave Switzerland, in order to prevent terrorist activities abroad. The Pass can be blocked.
- In – and exclusion: A Person is prohibited from one particular place to visit or to leave a certain place.
- House arrest: The hardest measure is to arrest the house. It can only be for persons of 15 years imposed. You must be approved by the court and can be monitored with an electronic ankle cuff.
“The extremists must not prevail”
Among the sharp critics of the law also Philip D. Jaffé, a member of the UN Committee on the rights of the child. He says that the planned law against the UN-children of the movement the Convention on the rights. In addition, the law would shift the Power from the specialized youth judges in the hands of the police.
Jaffé rejects, in particular, the prohibition of Contact for children 12 years of age. Further he noted that children from the age of 15 “could only be for a moment Suspected” placed under house arrest, without the evidence of a Crime existed. “There are children who can be dangerous, but the spirit of the Swiss legislation requires a humanistic approach.”
When the anti-terror law are not likely to prevail, the extremists said the Geneva Professor. That the UN would interfere with the representative in the debate, was not an attack on the sovereignty of Switzerland, but an act of friendship: “It is the role of international organizations, States, is to be monitored, in order to respect human rights.”
“A lot of letters to get”
Ida Glanzmann, CVP national councillor and President of the security-political Commission, expects that the Council will adopt the law. The majority of the SVP, FDP and CVP will not be from the Lobbying swayed. “We have already received in advance of the debate, very many letters, even from the Council of Europe. However, Switzerland must make a law to protect against terrorism.” The Federal police and the intelligence service needed more funds in order to defuse the threat by threat. Splendor man says that the age limit be detected also aware of young people: “We know from 15 – and 16-year-old Jihad-travellers, who were radicalized after the return total.”
Also SVP national councillor David Zuber Buhler says: “such A strong interference by the UN, I have never experienced.” The pressure of the human rights experts leave him cold.
