Elections should not be postponed. They are the starting point of parliamentary democracy. Power should be established on their basis. Constitutional law teacher Orlin Kolev said this to bTV.
He emphasized that the president is pressed by deadlines and this is the reason he gave Dimitar Glavchev less time to form a cabinet than he gave Gorica Grancharova-Kozhareva.
According to him, it is not appropriate for the current parliament to fill in the “home book” from which Radev can choose an acting prime minister. According to him, if the list is filled now, a person will not be chosen for the specific post, but a potential caretaker prime minister will be sought.
Kolev pointed out that political neutrality cannot be demanded when entering a person in the “home book”. The constitutionalist emphasized that the ombudsman is the most neutral, but perhaps the most inappropriate in view of the functions he performs. He added that if all the candidates for acting prime minister refuse to take up the post, then the president should turn to the SC for an interpretation of the application of Art. 99 par. 5 of the Constitution.
Orlin Kolev does not rule out the possibility that the Constitutional Court will be referred again to the changes in the Constitution and, more specifically, those concerning the caretaker government, after the expiration of the mandate of two of the judges. However, according to him, after the appointment of the new constitutional judges, the balance of power may remain unchanged.
