IPhone sold without charger: Brazil fines Apple

Apple got scooped a fine of 10.5 million Brazilian reals (1.6 million euros) in Brazil for the sale of iPhone without a charger in the box. This concerns in this case the iPhone 12.

Fine in Brazil for Apple and its iPhone 12 delivered without charger

Procon-SP, the Brazilian consumer protection regulator, explains that it imposed this fine on Apple for “False advertising, sale of a device without a charger and unfair terms”.

The Brazilian regulator had already contacted Apple last October regarding this story of the iPhone 12 delivered without a charger. He felt that Apple had not proven good for the environment with his practice. In December, Procon-SP asked Apple if the price of the iPhone 12 had been revised down, knowing that the AC adapter is no longer shipped with it. He also wanted to know what the price of an iPhone with and without a charger was and whether Apple had reduced the number of chargers produced. It turns out that Apple did not respond to requests from the regulator.

In fact, Procon-SP believes there are other issues with Apple, beyond the power adapter missing from the iPhone 12 box. The regulator says Apple has refused to repair iPhone 11 Pro’s. customers who had water related issues. There are also updates to iOS that caused problems with certain features and for which Apple has not offered help. Finally, Apple is exempt from any legal and implied warranty and any hidden or non-apparent defect according to the regulator.

Apple can still appeal

“Apple needs to understand that there are strong consumer protection laws and institutions in Brazil. He must respect these laws and these institutions ”, said Fernando Capez, executive director of Procon-SP. For its part, Apple can (if the company wishes) appeal the decision on the fine. The manufacturer has yet to publicly react to the fine.
