Investigation into the death of Magdalena Żuk. Important information from Egypt is missing

The case of Magdalena Żuk, who died 7 years ago during a trip to Egypt, is still not over. The investigation into her death was extended until the end of December this year. Prosecutors are still waiting for additional information from the Egyptian side. – We have requested the hearing of two experts who participated in issuing the toxicological opinion – informs the spokesman of the District Prosecutor’s Office in Jelenia Góra.

The tragedy occurred in April 2017 after 27-year-old Magdalena Żuk flew on a trip to the Marsa-Alam resort in Egypt. There, due to her deteriorating health condition, the woman was hospitalized. When the 27-year-old’s friend came to Egypt to take her to Poland, he learned that the woman was dead. She died as a result of injuries suffered after falling from the second floor of the hospital where she was staying.

Polish-Egyptian investigation

– As soon as Magdalena Ż. died, a Polish prosecutor and a forensic medicine expert went to the scene. There they participated in an autopsy, after which the corpse was brought to Poland and the autopsy was performed again. Later, some materials were obtained from the Egyptian side, but unfortunately, when it comes to Egyptian legislation on providing medical assistance, it is significantly different from ours. From the very beginning, we have been demanding additional information and data from the Egyptian side and they have been provided to us, but not to the extent that would allow for the substantive conclusion of the proceedings – said prosecutor Ewa Węglarowicz-Makowska, spokeswoman for the District Prosecutor’s Office in Jelenia Góra, in an interview with tvn24.pl.

The investigation in this case is extended until December 31, 2024.

– We are waiting for additional information from the Egyptian side, we have requested the hearing of two experts who participated in issuing the toxicological opinion. Despite the urgent note, we have not received these materials from Egypt to date, and they are necessary for our experts in Poland to issue a comprehensive toxicological opinion, which will allow us to make a substantive decision in this case – explains the spokeswoman of the District Prosecutor’s Office in Jelenia .

“There was no third party involvement”

Prosecutor Ewa Węglarowicz-Makowska added that “expert opinions show that the injuries you were diagnosed with were caused by a fall from a height.” “There were no signs on her body that she had been beaten or that third parties were involved,” he emphasizes.

Death while on vacation in Egypt

Let us recall that on April 25, 2017, 27-year-old Magdalena Żuk went on a trip to the Marsa Alam resort in Egypt. After two days, her behavior worried the woman’s partner, who had been in contact with her by phone. That’s why the man planned Magdalena Żuk’s earlier return to the country. Due to her deteriorating health condition, the woman was taken to hospital. At the same time, her friend came to Egypt to take her to Poland. In the hospital he learned that Magdalena Żuk was dead. She died as a result of injuries suffered after falling from the second floor of the hospital in Marsa Alam, where she was staying.

The investigation into the death of the Polish tourist is still being conducted by the District Prosecutor’s Office in Jelenia Góra. A Polish prosecutor and a pathologist took part in the autopsy carried out in Egypt. This activity was then also performed in Poland. Many documents were secured, including those on electronic data carriers, as well as opinions of experts in the field of forensic medicine, toxicology, biology, computer science, psychiatry and psychology.

The victim’s luggage and her mobile phone were examined and numerous IT data were obtained. Members of the injured party’s family, her former partners, friends, people traveling with her by plane, and those staying with her in Egypt – a total of about 200 people – were interviewed as witnesses.

Seven years of investigation

Prosecutors have been investigating the death of a Polish tourist since May 2017. So far, they have determined that no “sexual or any other violence” was used against the woman. According to investigators, the direct cause of the 27-year-old’s death were injuries she suffered as a result of falling from a great height. And although the proceedings are being conducted in a murder case, – as the prosecutor’s office points out – the final qualification will be adopted after collecting and analyzing all the evidence. The investigation into the death of Magdalena Żuk has already been extended several times.

The family is demanding compensation

The family of Magdalena Żuk, who died in Egypt, is demanding compensation from the Rainbow Tours travel agency from Łódź. However, it is not known what the amount is. “We believe that the office did not fulfill its duties regarding care. Contact with the family was based on the teenage sister. No one contacted the father, who was supposed to be notified in the event of any accident,” said Anna Cieślińska, Magdalena Żuk’s sister, in July.

She added that in this way she wants to sensitize the travel agency to the mistakes it has made. “If it helps at least one person or saves one life, then we do it. My sister was hurt. Very hurt. And the last stage was her death. And it could have been prevented,” said Cieślińska.

According to attorney Piotr Paduszyński, the family of the deceased is presenting financial claims which, according to the office, are unfounded. “The accident occurred in a hospital and the office is not responsible for what happened there. We asked for the lawsuit to be dismissed and we maintain this position,” the lawyer added.
