«The construction of a fictitious foreign residence» in Switzerland by Marella Caracciolo «had a dual and concurrent purpose: on the one hand, from a fiscal point of view, to avoid the subjection to taxation in Italy of large assets and income deriving from such availability ; on the other hand, from a hereditary point of view, remove the succession” of the lawyer’s widow “from Italian law”: the Turin magistrates write this in the seizure decree which led to yesterday’s raid (7 March) by the financial police , as part of the investigation into the Agnelli inheritance and the alleged “fraudulent declarations” of Marella Caracciolo’s income. For this reason, a new crime hypothesis was also triggered: “aggravated fraud against the State and a public body (Revenue Agency)”.
Among the assets in question – according to the Deputy Prosecutor Marco Gianoglio and the public prosecutors Mario Bendoni and Giulia Marchetti – there would be 734,190,717 euros, «deriving from the inheritance of Marella Caracciolo».
The three Elkann brothers, John, Ginevra and Lapo, the family’s historic accountant Gianluca Ferrero and Urs Robert von Gruenigen, the Swiss notary who took care of the testamentary succession, are being investigated for the aggravated fraud.
The investigators – emerges from the decree – also got their hands on a four-page document “summarizing in schematic form the days of actual presence in Italy of Marella Caracciolo”: morally, in 2015 Gianni Agnelli’s wife lived “in Switzerland less than two months”, compared to the 298 days spent in Italy. In 2018 the count is 227 days in Italy and 138 abroad. The name of the last page of the document is also significant: “A life of travel”.
