If you cannot access your vehicle for a long time due to an accident, the causer’s insurance must also pay for the loss of use. In a ruling by the Düsseldorf Higher Regional Court, the judges made it clear that the motor vehicle liability insurance not only has to pay for the repair of the car, but also for any loss of use. This is good news for injured parties, especially against the background of very long delivery times. As a person affected, you are still not obliged to visit other workshops in order to shorten the downtime. As a customer, one can assume that the selected workshop will “endeavor to obtain timely procurement” (Ref .: 1 U 77/20).
