Industrial Accident at West Kowloon Site: Two Deaths and Arrest Made in Occupational Safety Violation Case

Industrial accident at West Kowloon site

Two people died in an industrial accident at the West Kowloon site. The direct employer of the two deceased persons and the person in charge of the “second sentence” has been out of contact since reporting the case on Sunday. After investigation, the police arrested a 62-year-old man in Tsim Sha Tsui early yesterday morning on suspicion of violating the Occupational Safety and Health Ordinance. Security Chief Tang Bingqiang said yesterday afternoon that the police would do their best to collect evidence and would not rule out investigating the matter as manslaughter. It is said that the arrested surname “Buant” Shen is the person in charge of Shen’s establishment. He directly hired two workers.

The two victims, Kwok Huo Kee (61 years old) and Liu Haoxiang (63 years old), were employed by “Shen’s Creation” and went to the West Kowloon construction site last Saturday (23rd) to replace the seawater cooling pipes of the mall’s Elements air-conditioning system for the MTR. He stayed out all night and was found unconscious in the pipe the next morning. He was pronounced dead after being sent to the hospital. The 62-year-old person in charge, surnamed Shen Erpan, is suspected of violating the Occupational Safety and Health Ordinance. As an employer, he failed to ensure the safety and health of all employees at work within the scope of what is reasonably practicable.

Deng Bingqiang: Arrests on other charges are not ruled out

Tang Bingqiang said yesterday morning: “We do not rule out arresting this person on other charges later, including considering the manslaughter charge just mentioned. The incident is very serious and we will deal with it seriously and we will not let go of any evidence.”

Detectives from the Crime Squad, the Confined Space Search Team and the Government Laboratory personnel returned to the site where the incident occurred. The detectives brought oxygen bottles, ropes and other tools into the underground facility to collect evidence. Superintendent Jia Jinlin, Assistant Commander (Crime) of Yau Tsim Police District, described the case yesterday. After taking over the investigation, Yau Tsim Police District Crime Team had met with different parties involved in the case, including the site contractor, the project contractor, etc.

Preliminary investigation revealed that the site was undergoing a seawater pipe replacement project. Two workers went to work at the site last Saturday (23rd) morning. It was the third day they had started work at the site involved. They entered the pipeline with a contractor at 10 a.m. that day, and the contractor left the construction site about half an hour later. At 4 p.m., the construction site contractor sent people to the pipeline to understand the progress of the project, but did not find the two workers, so they left. and notify the contractor. The contractor received a call from their family members the next morning, saying that the two workers had not returned home all night and could not be contacted. He immediately rushed back to the construction site and entered the pipeline. He found the two workers unconscious and called the police.

The worker was found more than 100 meters away from the work site

Jia Jinlin said that the pipeline involved is relatively complex and can be divided into three stages: the first stage where workers only need to work more than ten meters away from the entrance and exit, the second stage where there are ramps or stairs to connect, and the third stage where it is more than a hundred meters away from the entrance and exit. meters, there are also ramps or stairs. Two workers were found at the third stage, and there were several inches of water at the scene. There were no gas bottles or other breathing apparatus beside them. The two workers were lying one hand apart, with several injuries on their bodies. Waiting for the medical examiner to determine the cause and time of death. The police will also investigate why the two ended up unconscious in that location.

The second judge lost contact after the incident and was found yesterday morning

Jia Jinlin said that the 62-year-old second judge had been out of contact since the incident and was arrested in Tsim Sha Tsui around midnight yesterday. He also said that the project has long been classified as a confined space, and the employer was involved in many procedures that were not done or omitted. Investigators will examine them one by one. If anyone is found to be responsible, they will be pursued. He added, “Any criminal offense is our final direction, and manslaughter is completely It’s not an erasure. If we prove that multiple people were grossly negligent and reached a prosecution threshold, we will make arrests and prosecute.”

A group of more than ten family members of the two deceased people arrived at Elements yesterday morning and met with MTR representatives for about an hour. Both the Liu family and the Kwok family criticized the MTR’s compassionate plan as being insincere, saying, “(Can you disclose the amount?) No (disclose) , in short, not sincere… I hope they can discuss with the top management a more reasonable plan, which will at least solve our problem in the next two or three years, until the verdict is announced, and at least provide financial assistance to our lives.”

The MTR Corporation expressed its deepest condolences to the family, saying that it attaches great importance to the incident and has set up an investigation team to follow up on whether the contractor and subcontractors have violated safety systems and review the company’s supervision mechanism. It will assist the family in holding funeral ceremonies and coordinating with the contractor. Provide financial support.
