Infringement of copyright and related rights is part of the criminal code in Russia
Around the world, many technological giants have stopped selling to Russia. Faced with the "choke", Russia said it will legalize software piracy. The move comes in response to several software companies, notably Microsoft, Cisco, Oracle, NVIDIA, IBM, Intel and AMD.
Russian officials are crafting a set of measures to support the country's economy against pressure from foreign sanctions, and when it comes to software licensing, the proposal gives the green light to a form of piracy. More specifically, the plan suggested by the Russian authorities is to establish a "unilateral" software licensing mechanism that renews expired licenses without requiring the consent of the copyright or patent owner.
This special procedure will be eligible for cases where the copyright holder is from a country that has supported sanctions against Russia and only for products with no Russian alternatives available.
It should be noted that the article 1360 of the Civil Code of the Russian Federation allows the government to "use an invention, utility model or industrial design without the consent of the patent holder" without permission, provided the patent holder is notified and a reasonable "fee" is paid.-
Infringement of copyright and related rights is part of the penal code in Russia, punishable by up to six years in prison and fines of up to 500,000 rubles, or three years of the offender's salary.
