The prosecutor, acting in the interests of the child, filed a lawsuit against the administration of the Lensk Municipal Municipality for compensation for moral damage. The court satisfied the prosecutor’s demands.
On the day of the incident, the girl was walking home from school. On the way, she was attacked by a dog. The court found that, in addition to the long course of vaccination that the child had to undergo after being bitten by a dog, the girl experienced mental and moral suffering.
The city administration did not agree with the demands, pointing out the presence of an organization responsible for catching stray animals. However, the court noted that according to clause 14 of part 1 of article 14.1 of the Federal Law “On the General Principles of the Organization of Local Self-Government in the Russian Federation”, measures for the treatment of animals without owners fall within the competence of local government bodies.
As a result, the court decided to collect compensation in the amount of 80 thousand rubles from the Lensk administration.
