“It is an attack on the most elementary probity and morality, I’m ashamed to sit with you », Launched this Thursday evening Joseph Roudillon, in the hubbub of the municipal councilors of Montluçon (Allier) leaving the council room prematurely.
His opposition group and that of the left stood up as one man as the municipal majority had just voted a deliberation granting the former municipal councilor Bernard Sistou functional protection. The attorney’s fees related to his indictment for illegal taking of interest can thanks to this measure be paid by the community up to an amount of 4,000 euros.
It’s illegal, according to the opposition
For Joseph Roudillon (DVD), this deliberation is “illegal and shameful”. Functional protection is excluded, declared the lawyer, when “the fault is detachable from the exercise of the functions”. This is “obviously the case for the illegal taking of an interest, which is the fact of taking advantage of one’s functions to obtain an advantage in a personal capacity, directly or indirectly. In the present case, to have prejudiced the interests of the community of Montluçon. We are not here to say whether this former elected official is guilty or not, but that is what he is accused of ”.

The mayor Frédéric Laporte affirms that it is well as an elected official that he was indicted, not as an individual. He is accused of having attended the debates (from the municipal council, editor’s note). It is an elected opposition member who has every right to have functional protection and this could benefit other elected representatives. “

What case are we talking about?
As a reminder, in this case, the former mayor Daniel Dugléry (LR) and the former municipal councilor Bernard Sistou (ex-Left Front) are indicted for illegal taking of interest.
Montluçon: Daniel Dugléry indicted for illegal taking of interest (February 2018)
Justice is interested in land that the city of Montluçon sold to Bernard Sistou in 2010, at a price that could be judged to be disadvantageous for the municipality, while he was a municipal councilor.
This acquisition enabled Bernard Sistou to inaugurate in June 2012 a leisure complex on the Sainte-Agathe plain, opposite the golf course of the same name, which he no longer owns today.

The city had acquired these lands 69,000 euros in 2005, and would have invested tens of thousands of euros to develop them.. However, on June 17, 2010, the municipal council voted to transfer the plots for an amount of 40.000 euros.
Surprisingly, this 2010 deliberation also did not specify the presence on the grounds of a clubhouse or even three tennis courts, although these elements did appear on the authentic deed of sale.
The “awful jojos” of the opposition
These two opposition groups – which Frédéric Laporte described after their departure as “awful jojos” – were surprised that the mayor was going in force whilea municipal commission had given an opinion contrary to the deliberation unanimously. “A certain number of elected officials asked me questions on this subject after the commission and I gave them an answer”, underlined the mayor. All the elected representatives of the majority voted for this decision yesterday, even those who had rejected it in committee. The thirteen opposition municipal councilors voted against it.
Left municipal councilor Pierre Mothet said Thursday that he had received from a “citizen” a copy of an invoice (what The mountain was able to consult) which would have been sent in 2019 by Bernard Sistou’s lawyer to the city for the community to pay costs in connection with the indictment of the former municipal councilor.
“Has the bill been paid by the city? “, asked Pierre Mothet.

“Would the municipal treasurer, a state employee, pay an invoice to the city’s account addressed to an individual ?, Frédéric Laporte asked in turn. […] I have no power over her. Each time you request a payment, you need supporting documents. It is for this reason that we make a deliberation, if in the future we must make a payment within the framework of this procedure.. »
Pierre Mothet added that his group would request the exhaustiveness of the legal invoices paid by the community since 2014.
At the end of the session, Frédéric Laporte returned to this heated debate, believing thatwe “flouted democracy”. “Next time they don’t leave the room, do they invade it?” “For their part, the groups of Joseph Roudillon and the left wrote a letter to the sub-prefecture on Thursday evening to alert it to the” illegality “of this deliberation.
