Since 2021, the annual point of the steering committee dedicated to domestic violence has been held. Can you remember what it consists of?
Brice PARTOUCHE, public prosecutor of the judicial court of Thionville : “This committee formed within the jurisdiction aims to improve the fight against intra-family violence, the care of victims and perpetrators throughout the criminal procedure. The idea is to associate all the actors of the court, the domestic violence project manager, the extended judicial actors, the lawyers and all the partners of justice, the investigation services, the association for assistance to victims, the association which sets up awareness-raising sessions on domestic violence, the prison service for integration and probation and the prefecture, which is responsible for the support and monitoring of victims. »
A quantified point, to realize the situation on the spring of the Thionville living area?
“The prosecution received 800 domestic violence procedures in 2022. A figure equivalent to that of 2021, but three times higher than in 2019. 60% of the violence has not been medically recorded, either because there is no trace of a blow, because it is threats or harassment, which amount to psychosomatic violence. Last year there were 30 immediate appearances, 60 referrals with placement under judicial supervision and 75 cases decided on summons to the hearing. Added to this are more than a hundred alternatives to prosecution; all in all, we have about 210 orders for the eviction of violent spouses. The jurisdiction has 30 serious danger telephones, 27 of which have been attributed to the victims. 6 anti-reconciliation bracelets were decided by the court. »
What about the care of the victims by the police?
“With them, we discussed the issues of taking complaints, recalled its systematization in police stations and gendarmeries. We took stock of the taking of complaints to the hospital, the legalization of simple information from relatives, but also the investigation phase, recalling that there was now the medico-judicial unit within the CHR of Bel -Air. »
Let’s talk a bit abouts hearings dedicated to domestic violence, once a month in court…
“These are supplemented by an assessment of the victim, a written report on the judicial review of the person concerned and a report on the feasibility of an electronic bracelet. Before the hearing, a film for the attention of the authors is shown. The victims are physically accompanied by the victim support association. »
What is your assessment of the systems implemented by your jurisdiction?
“Our systems are now robust, proven, with small gaps to fill: revitalize the reinforced judicial control program and anti-reconciliation bracelets, refine the question of the eviction of perpetrators in appropriate structures. I would point out that due to a lack of staff, we have eliminated criminal hearings, while setting up those for domestic violence. The objective is to reduce summons times by offering more hearings, within the limits of our resources. »
