The text of Law No. 71 of 2009 issuing a law Psychiatric patient care According to the latest amendment in 2020, that “Without prejudice to any harsher penalty stipulated in another law, the crimes mentioned in this law shall be punishable by the penalties stipulated in the following articles:
The following shall be punished by imprisonment for a period not exceeding two years and a fine of not less than five thousand pounds and not exceeding ten thousand pounds, or by one of these two penalties:
– Every doctor who deliberately proves in his report what is contrary to reality regarding the psychological or mental state of a person with the intention of admitting him to the facility or removing him from it.
– Whoever deliberately detains or causes the detainment of a person in his capacity as suffering from a psychological or mental illness in places other than those stipulated in this law.
A penalty of imprisonment for a period not exceeding six months and a fine not exceeding three thousand pounds, or one of these two penalties, shall be imposed on:
– Anyone who intentionally enables a person subject to entry procedures or compulsory treatment to escape, helps him to do so, or conceals him by himself or through others, while knowing that.
– Anyone who prevents the inspection authorized by the National Council for Mental Health or the Regional Council for Mental Health, or whomever he delegates, to be carried out in accordance with the provisions of this law.
– Anyone who refuses to give information needed by the National Council for Mental Health or the Regional Council for Mental Health or its inspectors in the performance of their mission or gives information contrary to the truth with his knowledge of that.
– Whoever falsely notifies a competent authority with malicious intent against a person that he suffers from a mental illness as stipulated in the provisions of this law.
