The Antimonopoly and Consumer Market Control State Service under the Ministry of Economy has received a request for the import and sale of single-use electronic cigarettes, which do not have the necessary information in Azerbaijani on their boxes, as well as the corresponding warning in Azerbaijani about the harmful effects on the health of consumers, contrary to the requirements of the current legislation.
SIA was informed about this by the State Service.
The facts mentioned in the application were investigated and relevant letters were addressed to the enterprises that import the mentioned products into the territory of the country about adapting the labeling of the products they sell to the requirements of the legislation and informing the State Service about the result.
It should be noted that according to Article 13, Clause 1 of the Law “On the Protection of Consumer Rights”, the seller (executor) must provide the consumer with the necessary and correct information about the consumer properties of the goods of interest to the consumer, the conditions of acquisition, the methods and rules of operation, storage and safe use of the goods. In accordance with Article 13, Clause 3 of that law, Article 7.4 of the Law “On the State Language in the Republic of Azerbaijan” and Clause 5.8 of the “Rules of trade, public catering, household and other types of services in Azerbaijan” approved by the Cabinet of Ministers Resolution No. 94 dated 03.04.2014, labels and names on the goods and products imported into the country, as well as explanatory leaflets on their use in other languages, It must be accompanied by a translation into Azerbaijani.
At the same time, according to Article 1.0.1 of the Law “On Limiting the Use of Tobacco Products”, all types of hookahs and electronic cigarettes are treated as tobacco products within the scope of that law. According to Article 14.3.4 of the Law “On Tobacco and Tobacco Products”, there must be a warning in Azerbaijani on the boxes (packaging) of tobacco products imported into the country, including disposable electronic cigarettes, about the harmful effects on human health.
