JAKARTA, KOMPAS.com – Indonesia Corruption Watch ( ICW) urged Tri Rismaharimi not to concurrently serve as Minister of Social Affairs and Mayor of Surabaya and to leave one of his posts.
ICW researcher Wana Alamsyah said, duplicate positions Risma at least it has violated Law Number 23 Year 2004 concerning Regional Government and Law Number 39 Year 2008 concerning State Ministry.
“Public officials should have the ability to understand regulations and be oriented towards the public interest. This is even more so if the officials are in the same class as the president and mayor with achievements that are said to be classy,” Wana said in a press release, Thursday (24/12/2020).

Wana said, Article 76 letter h of the Local Government Act clearly contains a ban on regional heads and deputy regional heads to perform duplicate positions as other state officials.
Meanwhile, Article 23 letter a of the Law of the Ministry of State regulates that the Minister is prohibited from holding the office of other state official.
Referring to other regulations, namely Article 122 of Law Number 5 of 2014 concerning State Civil Servants, ministers and mayors are referred to as state officials.
Wana said President Joko Widodo’s decision to allow Risma to hold concurrent positions was also considered problematic.
“A statutory order cannot be ruled out by the President’s permission, let alone only a verbal permit. The appointment of Risma as minister without leaving the mayor’s position can be considered legally flawed,” he said.
Wana added, normalizing the practice of multiple positions is the same as normalizing something that can lead to corrupt behavior.
This is because concurrent positions can potentially create a conflict of interest when formulating a policy.
“The permission given by the President to Risma to carry out multiple positions shows more permissive practices towards corrupt practices. Moreover, the decision violates the law and erodes the value of public ethics living in society,” said Wana.
As previously reported, Risma said that for the time being he was concurrently serving as Minister of Social Affairs and Mayor of Surabaya.
He said President Joko Widodo allowed him to temporarily return to Jakarta and Surabaya.
“Maybe because I am concurrently the mayor for a while. I have the President’s permission, ‘It’s okay, Mrs. Risma to go home’,” said Risma in a virtual handover of the position of Minister of Social Affairs at the Ministry of Social Affairs, Wednesday (23 / 12/2020).
Risma said she would return to Surabaya to inaugurate a bridge, sports museum, and other agendas that she had to attend.
“It’s a shame if I don’t inaugurate (the bridge) and want to inaugurate the sports museum because there is Rudi Hartono’s jersey, Alan Budikusuma’s racket, I want to inaugurate it for the children of Surabaya,” he said.
