ICE deports an entire family to Cuba due to “a confusion” – 2024-04-05 07:53:04

A Cuban family residing in the United States was deported to Cuba without prior notice, and they are in a desperate situation after they could not even try to stop the process.

According to the report of Telemundo 51Guillermo Picos, his wife and son, residents of North Carolina, were detained and deported without even being given the opportunity to contact their lawyer and stop the expulsion.

The family arrived in the country in November 2021, through the border area located in the Arizona territory. After being processed for immigration, they were granted the I-220A form to be able to remain in the United States.

The document represents a “Provisional Release Order” under parole, so those involved must obligatorily attend hearings in the immigration court, as well as maintain good behavior while their situation is resolved.

The family filed a request for asylum, which was denied and, at the same time, they received a notice to appear before an Immigration Court in Charlotte, dated February 16, 2023.

Although they had supposedly been allowed to remain on parole while awaiting their hearing, a misunderstanding led to their deportation, when Immigration and Customs Enforcement (ICE) scheduled an interview for the family on the same day. your court hearing.

The family prioritized the interview with ICE and arrived late to court, so the magistrate in charge of this instance decided to deport them due to absence. Shortly after, the agency contacted them for a supposedly routine hearing, but there they were arrested and that same day they were sent to Cuba.

The family’s attorney, Grisel Ybarra, filed a motion to reopen the case before the Immigration Judge, arguing the error in scheduling the interview. However, the application was denied, and she now has an appeal pending before the Board of Immigration Appeals.

The request, however, does not stop the removal, and the family hopes that return to the US will be considered, since ICE rarely deports families with children while the case is still under consideration.

“In the 47 years that I have been practicing, I have never seen a Cuban child be deported,” the lawyer told the aforementioned media.

For his part, the minor’s father hopes that everyone can return, especially his son, so that he can fulfill the ‘American dream’.

“He was preparing for his final high school tests, the only thing I ask is that they return to us so that my son can fulfill all his dreams and get ahead,” Picos commented in a video call.
