“I am determined, it must stop”: in Fabas, owners of felled trees are ready to go to court after the failure of reconciliation

The conciliation hearing that was to be held this Monday, October 14 between the owners of the Fabas wood plots, in Ariège, and the forester who had cut their trees without permission came to an end. The eight victims are now preparing to go to court.

Anger is brewing among eight owners of timber plots in Fabas, in Ariège, who saw nearly 2,000 of their trees cut down illegally by a forester from Haute-Garonne, Manuel Ribeiro Nunez, in the May last year. After long months of waiting, the latter did not appear at the settlement hearing that was to be held this Monday, October 14 at the gendarmerie Sainte-Croix-Volvestre.

“I really didn’t believe it,” Philippe* sighs in a tired tone, “but it simply didn’t come.” with him, but his insurer will not be able to do anything.” This is confirmed by another owner who wishes to remain anonymous at the moment: “I contacted the I have insurance, which is the same as Mr. Nunez’s insurance, he assured me that the insurance will never pay for him, no insurance will work.”

“These were areas that were passed down from generation to generation. “

So everyone agrees, they have to go to court to get compensation for the damage. “You understand, these were plots that were passed down from generation to generation, there were hundred-year-old trees, following Fabassienne Furthermore, I learned that we had to replant the side of -within five years, it is “It is the law. But we would have. to count all that, it costs to replace.”

A question among many others that also worries the victims. Therefore, according to several of them, the unscrupulous forester stopped his activity and retired in June, just after he finished felling their trees, information that we could not verify. “It must be broke and unpaid,” the same owner suspects, “so I don’t know what could happen.” A situation that could leave some of the owners injured not to take legal action, lest they have to incur costs without hope of being compensated.

“He offered us 5,000 euros to share between everyone”

Another question that is sure to arise is what is the actual value of cutting wood. Claude *, an owner we met a few days ago and himself a former forester, estimated the value of 40 cubic meters of oak cut on a small plot of 300 square meters at 12,000 euros – a small fraction of the 15,000 square meters of wood victims of these clear fellings, which do not take into account other quality species such as chestnut trees, or the wood of lesser value that is present in quantity.

“And for all that, he offered us 5,000 euros to share between everyone,” said one of the victims. “We came across someone who is not going to pay and who ‘going to drag on,’ said Claude, a little disappointed that the mayor of Fabas, a “friend”, has not responded at the moment.

For now, the eight owners are waiting without much hope for a response from the forestry insurer. They will also have to contact the mayor of Perles-et-Castelet in the coming days, where a similar case hit the headlines after 350 trees were illegally cut down in 2021 to find, before they hear his last act before the courts on October 8 last. “We would like to hear from the lawyers who handled this case to ask for advice,” explained Philippe.

“At least I am determined, it has to stop and not only in Fabas, in all of France,” concluded one of the victims, “This is rubbish.
