The man was indicted on March 9 last year for having sex at his home in Busan, despite his Thai wife’s refusal. The man was also charged with attempted coercion when he tried to sexually assault his wife on the 12th of the same month.

The man was introduced to a woman in July 2021 through an international marriage broker, and submitted a marriage registration in September of the same year. Two months later, in November of the same year, the man met the woman for the first time in Thailand. However, the two could not meet for a long time due to visa procedures and the influence of Corona, and on March 8 last year, the woman entered South Korea and spent the first night.

During the course of the trial, the man claimed that the woman had approached him to obtain a visa to stay in South Korea. The prosecution, which demanded a three-year prison term for the man, said, “The defendant paid the victim and brought him to South Korea, so it was determined that he committed the crime with a ‘wrong view of the couple’ that he was obligated to have sexual relations. “If the victim strongly resisted sexual relations, they could be forced to leave the country, so they could not resist.”

Meanwhile, seven jurors in the public participation trial voted unanimously to acquit.

The Busan District Court also said, “Although it is admitted to some extent that the defendant used a somewhat coercive method to force a sexual relationship, there are cases where the victim said that he uttered abusive words, or that he had forced sexual intercourse by assault or intimidation when he was unable to resist. The statement is unbelievable,” and added, “Even if the sexual relationship was carried out in a rather coercive manner, it reached the level of essentially infringing on the spouse’s right to self-determination of sexuality, as the Supreme Court’s precedent has said.
