Human Rights Organizations Appeal Court Ruling on F-35 Fighter Jet Parts Delivery to Israel

Human rights organizations Oxfam Novib, PAX and The Rights Forum are appealing against the court ruling on the delivery of parts for F-35 fighter planes from the Netherlands to Israel. They want that supply to be stopped immediately.

“There must be a different ruling. The need is very great,” Thomas van Gool, Israel-Palestine expert from PAX, told NU.nl.

According to human rights organizations, the warplanes contribute “to threatened genocide and large-scale and serious violations of the laws of war in Gaza.”

On December 15, summary proceedings that the organizations had filed against the State were filed. They demanded a ban on the export of F-35 fighter jet parts to Israel.

The judge ruled that the Netherlands could continue with this and that the permit granted in 2016 did not need to be reassessed for the war between Hamas and Israel.

‘New situation requires new assessment’

“We are now faced with the threat of genocide and the Netherlands will continue to deliver,” says Van Gool, who believes that the situation is now very different than eight years ago. “Then you also have to reassess it.”

According to PAX and the other organizations, the Dutch State has a duty “to prevent threatened genocide and not to contribute to it”. Arms exports to Israel must therefore be stopped and the State is acting unlawfully, they believe.

Organizations point to the Geneva Conventions and arms export regulations

For this they rely on the Geneva Conventions and European and national arms export regulations. “It is not something to weigh, but it is a firm obligation that the Netherlands has,” says the PAX expert.

The appeal is due on January 22. “That can be done so quickly because we have requested turbo speed. We are confident that the judge will rule differently this time.”
