The case of Huila lawyer Carlos Eduardo Tejada Martínez was recently heard, to whom the National Judicial Disciplinary Commission confirmed a sanction against him for not observing his duties and acting in a fraudulent capacity to favor a citizen sentenced to 140 months for trafficking. of narcotics and conspiracy to commit a crime.
As is well known, the events date back to March 5, 2019 when the lawyer, acting as a trusted representative of Mrs. Oneida Barreto Coronado, within a criminal process, presented before the Fourth Court for the Execution of Penalties and Security Measures from Neiva a request to change the intramural prison to serve the sentence in a prison in the indigenous jurisdiction of the Talaga reservation in the municipality of Páez, Cauca.
For these purposes, Tejada Martínez attached a certification issued by the governor of the council, which stated that his agent was part of the aforementioned reservation, as well as a report from the director of the La Plata prison, Huila, which stated an accreditation about the reservation as an appropriate place for the convicted person to continue serving her sentence. However, these documents recorded facts that did not correspond to reality.
Given these events, the Disciplinary Jurisdictional Chamber of the Sectional Council of the Judiciary of Huila opened a disciplinary process against the lawyer Tejada Martínez, proving, among other things, that the signature of the director of the prison center had been impersonated. Right there it was learned that this was not the only case of impersonation.
For this reason, lawyer Tejada was sanctioned with exclusion from the exercise of the profession, a decision that has been ratified by the National Judicial Discipline Commission.
Jurists must set an example of probity, rectitude, seriousness and sincerity, even if at times they have to dress as ‘devil’s advocates’. And in the face of lawyers who ‘taint’ the practice of the profession, punishments must be exemplary.
