August 15th belongs to the legally exceptional holidays, during which the operation of businesses is prohibited, except for those that operate legally on Sundays and holidays.
August 15 Employment and Remuneration
We distinguish the following cases:
- Employees, who are not employed on August 15 and
- Employees who will work on August 15, as well as depending on the method of payment of their remuneration, i.e.:
- They are paid by the day or
- They are paid a monthly salary.

Examples
Let workers A and B, in different activities, paid a monthly salary of 1,000.00 and a statutory salary of 830.00, worked 7 hours on August 15, 2024 and
· A in a business that operates legally on Sundays and other statutory holidays and
· B in a business that does not operate on Sundays and other statutory holidays
According to table 1, for the 7-hour work on August 15, we have:
August 15th holiday and leisure leave
Article 2 par. 3 of AN 539/45 stipulates that official or customary public holidays are not included in the annual paid leave.
Consequently, for those employees who are absent on leave on August 15, this day is not counted in the (working) days of the leave, i.e. their leave is increased by one working day.
The non-inclusion of August 15 also applies to continuous operations (permissible employment on Sundays and holidays), only if the day is non-working during the work schedule.
Examples
1. Employee C works in a company that operates legally on Sundays and legal holidays, with a 5-day work system and receives the 10-day part of his leave on Monday, August 12, 2024, then he will return on Monday, August 26, 2024, because according to the work schedule, the days of the week rest days are Friday 16 and Sunday 18 August 2024.
2. Employee D works in a business that legally operates on Sundays and legal holidays, with a 5-day work system and receives the 10-day part of his leave on Monday, August 12, 2024, then he will return on Tuesday, August 27, 2024, because according to the work schedule, the days of the week rest days are Thursday 15 and Sunday 18 August 2024 and
3. Employee E works in a business that DOES NOT operate (LATE) legally on Sundays and legal holidays, with a 5-day employment system and receives the 10-day part of his leave on Monday, August 12, 2024, then he will return on Tuesday, August 27, 2024
