This legislation allows a series of benefits to people with disabilities and the family members who care for them. Our Experts had already analyzed the bonus Law 104. Today, however, we will understand how to obtain home health care thanks to Law 104. First of all, it is necessary to evaluate the existence of the requirements to request the protections provided. The severity of the conditions of the person concerned and the evaluation of socio-economic indicators of the entire family unit regulate access to benefits.
In other words, the law exists but the criteria are certainly stringent. We remind you that the protections provided for by Law 104 do not cover the disability pension. The latter, in fact, is an economic treatment aimed at the person with disabilities. Law 104/92 also protects the family member who takes care of the handicapped. By allowing, for example, paid leave for the purpose of caring for a sick relative.
The expected economic contributions
The INPS contribution, which reaches 1,000 euros, is one of the benefits paid to the family member to partially cover some expenses. For example, home care carried out by specialized personnel. Together with the disbursement of the bonus, the legislation provides for other professional assistance services.
From the speech therapist to the physiotherapist, up to the support of a psychotherapist and the patient transfer service for treatments, visits or therapies. To request the contribution, interested parties must visit the social security institution website where it will be clear how to obtain home health care thanks to Law 104. INPS will also ask to attachISEE in order to analyze the economic condition of the applicants. Only the joint assessment of the state of health and economic conditions will establish the possibility of accessing this subsidy.
The Home Care Premium project
The INPS, in addition to managing the economic contributions for the family members of people with disabilities, is studying another project. That is the extension of the current trial called Home Care Premium. Thanks to this initiative, thousands of people with disabilities will be able to follow personalized therapeutic programs directly at home. The current test phase will end on 30 June 2022 and is guaranteeing important services to around 30,000 people. Interested parties can apply for Home Care Premium at any time. This can concern both new users and cases of aggravation compared to the previous request.
How to get home health care thanks to Law 104
The INPS annually announces the possibility of requesting the financial contribution which can reach up to 1,000 euros. This benefit is extended to any family member who takes care of the disabled person. The social security institution will establish the amount of the bonus on the basis of precise economic and health criteria. The maximum ISEE for obtaining the grant is 8,000 euros. The condition of health is instead established by the report issued by the medical commission responsible for the certification of disability.
This commission may in fact establish the nature of the benefits by defining the seriousness of the conditions of the disabled person. The criteria are clearly indicated in paragraphs 1 and 3 of the same Law 104/92. The report supplementing the visit will then establish the subsequent services in favor of the patient.
