The lawyer spoke about the mechanism for booking conscripted workers.
The Verkhovna Rada will soon again extend the martial law and general mobilization in Ukraine. The relevant laws on the approval of the decree will be introduced by President Volodymyr Zelensky in the near future.
Vladislav Yurchak, lawyer at T&T Partners comments “Channel 24” spoke about the features of the mechanism for booking military service workers.
So, according to him, for the approval of the General Staff of the Armed Forces of Ukraine, the heads of government bodies or enterprises must first provide lists of employees who are planned to be hired.
However, there are restrictions on the number of “armor” of men liable for military service.
For example, business representatives can count on only 50% of employees and only critical ones, so that the enterprise does not stand idle in their absence.
The received lists are worked out and coordinated in the General Staff or in the SBU or intelligence, if we are talking about civil servants. The final decision is made by the Ministry of Economy. And after that, the General Staff transmits data on those booked to the territorial recruitment centers.
If an employee is on the booked list, they may receive a deferment from service that is valid for six months. After this period, the procedure will need to be repeated.
Which workers are subject to “reservation” from mobilization:
- producing goods, performing work and providing services necessary to meet the needs of the Armed Forces of Ukraine or other military formations;
- critical for the functioning of the economy, as well as ensuring the livelihoods of the population in a special period.
It is also reported that enterprises and organizations that meet certain criteria are considered critical, one of which is the total payment of taxes, fees and charges in the amount of 1.5 million euros per year.
