Jörg Diskowski remembers that he wanted to buy “some repair part”. Also that he didn’t get this part in the Villinger Bauhaus market, wanted to drive away again and touched a matt-painted black BMW when parking.
What happened in the minutes that followed on December 27, 2022, the Tuesday after Christmas, is in the dark for him. The fact is: The 69-year-old woke up on the asphalt parking lot, with bleeding wounds and a sore head. Now he is urgently looking for a witness who is said to have seen the incident.

Today, more than twelve weeks later, the Niedereschacher is standing on the parking space right next to the entrance to the hardware store and no longer understands the world. “I was clearly depressed,” says Jörg Diskowsi. But he has not yet received legal recognition for his injuries – on the contrary.
The opponent of the accident pleaded self-defense and for his part charged the 69-year-old with attacking him first. Diskowski rejects this. He still remembers that the much younger opponent of the accident shouted at him aggressively: “Don’t touch my car!”
Sad New Year’s Eve in the hospital bed
Jörg Diskowski, who was already in poor health after a stroke more than ten years ago, is still suffering from the consequences of that December afternoon. He had to spend almost a week in the hospital and celebrated New Year’s Eve in the hospital bed. To this day, he still can’t use his right arm properly, apparently as a result of the concussion, he says. “I can only work on the PC if I use both hands for the mouse,” explains the 69-year-old former computer specialist.
Diskowski wants compensation for his suffering, but the prospects are bleak. So far, no witnesses who have observed the course of events have come forward. He was traveling alone and has no memory himself. Hardware store employees and customers who provided first aid only came later. The opponent’s wife, however, who was in the car, referred to her right to refuse to testify.

The public prosecutor’s office in Konstanz is not pursuing the case any further. Too little is known about the course of events, explains press spokesman Andreas Mathy. Both parties accuse each other that the veracity cannot be verified, according to police spokesman Jörg-Dieter Kluge. According to Andreas Mathy, other characteristics such as low motives for the crime were also not fulfilled.
“Then the principle applies: in case of doubt for the accused,” says the lawyer. After all, the authority “cannot prosecute every physical injury”. The matter was referred to private prosecution, which could even lead to a hearing. According to Mathy, the public prosecutor’s office is left out here.
But things are not that simple for Jörg Diskowski. Because the chances of success are bleak, his legal protection insurance refuses to cover the costs of such a procedure. The only hope: The witness who is said to have observed the incident according to the first responders reports.
He wants to donate the compensation
“If I don’t find this woman, he won’t get away with anything,” complains the pensioner. “It’s not about the compensation for pain and suffering, I would even donate it,” he emphasizes. But it is important for him to make it clear that something like this simply shouldn’t happen in our society.
