ANAF explained in April, in an answer to G4Media.ro, that, due to legal proceedings regarding the estate, it cannot recover another building belonging to the president, the commercial space at 29 Nicolae Bălcescu Street , or the 260,000 euros received from the rent. of the president’s family.

The state, through ANAF, cannot obtain the certificate of the heir of the property in Bălcescu 29, as it already obtained for the property in Magheru 35, a document that was challenged in court by the family friend Iohannis. At the same time, the commercial space is not used.

According to ANAF, immediately after registering the ownership of the commercial space, the Romanian state can ask the Iohannis to return the rent collected in the period 1999-2016, when she owned the property illegally .

“The amounts that represent income from the transfer of the use of goods can only be recovered by the owner recognized by law”, explained ANAF.

The two buildings in Sibiu are nationalist houses in the 1960s

According to the history of the estate reconstructed by risproject.ro and the Media Research Center (CIM), both buildings belonged to Eliseu and Maria Ghenea (formerly Baştea). The buildings were nationalized in the 60s by the communist regime.

After the Revolution, in the 90s, a suspected heir appeared, Ioan Baştea, a great-grandson of Maria Ghenea (formerly Baştea). In 1999, he received a court decision revoking the nationality ordered by the communist state in the 60’s.

On the same day, Ioan Baştea sold, for only 3,200 dollars, half of the building in Nicolae Bălcescu to Klaus and Carmen Iohannis.

“This is how the Iohannis family becomes the exclusive owner of the commercial space which, in the next 17 years, brought almost 1.3 million lei, about 260,000 euros, at the current exchange rate,” wrote the journalists from risproject.ro.

Two of the buildings owned by Klaus Iohannis and his wife, Carmen, in Sibiu belong to the state, and the money received from the rents, 260,000 euros, must be returned, according to a final decision made passed on Wednesday by the High Court of Scotland. Cassation and Justice (ICCJ).

The decision of the High Court was made as a dispute over the right of inheritance to property, which is a way for the state to recover rent money collected by the president’s family.

The Supreme Court of Cassation and Justice decided on Wednesday in a lawsuit that was opened in 2016, regarding the estate of a building that belonged to the wife of the president, Carmen Iohannis, Digi24 reminds. The trial was opened by Rodica Baștea, a friend of the Iohannis family, who was established in Miami, who owned the individual property together with Carmen Iohannis and her mother-in-law. Rodica Baștea requested in court that the certificate by which the Romanian state was named as the legal heir of a building in Sibiu be cancelled. Rodica Baștea lost the case in all courts, and on Wednesday the Supreme Court rejected her appeal.
