Denouncing a tax injustice on the TEOM since 2011 and with a case law of February 2, 2022 in Nancy, the communists invite the inhabitants of Biterrois to claim the overpayment.
It is a workhorse that the Biterrois Communist Party has been leading since 2011. And that it is riding again today, this time with the backing of case law. I’“tax injustice” finger pointing? That of the household waste collection tax (TEOM). “It is overvalued: there is more money collected than what is actually used, explains the communist elected Nicolas Cossange. Each year, since 2011, between 3.5 and 3.9 M€ are returned by the Agglo to the City of Béziers and therefore between 3.5 and 3.9 M€ in excess that the Biterrois taxpayers would pay.
Pointing to this “scandal” since 2011, Aimé Couquet adds: “Couderc who had increased the TEOM by 37% in 2011 before the transfer of competence in 2012, Lacas and now Ménard: the successive elected officials have never reacted. If we do the calculation, it is 30 M€ which are due to the taxpayers .”
“Tax Laundering”
If the PC brings this sea serpent up to date, it is because a very recent case law has just brought water to the mill of its arguments. On February 3, 2022, the Court of Appeal ruled that the TEOM of the Grand Nancy metropolis “was established unlawfully”. It acknowledges to Lorraine taxpayers “the right to benefit, at their request, from the reduction of the amount of the TEOM charged to them for the year 2018”. “We are in exactly the same situation. We are now inviting Biterrois taxpayers to be reimbursed for the overpayment of this tax”rebounds Nicolas Cossange.
Former consultant to communities, Joël Clérembaux agrees with the communists: “Jurisprudence has often reminded us: the proceeds of a tax must serve and finance exclusively the operation of the service concerned. 4 M€ to the municipalities, including 3.4 to Béziers. By transforming the proceeds of a tax into tax proceeds, we have there a tax laundering, an illegal and unfair transfer.”
