The new work decree changes an important factor of the notarial deed for the house: it will no longer be mandatory to enter a specific data and this represents a drastic change.
Buying a housewe now know, does not just involve looking for the property and then paying whoever sells it or being able to obtain the mutual from the bank or pay the taxes to the Revenue Agency. Buying a house also means having to get in touch with a notary and start the process of the deed for the purchase, this item which we can define as one of the most expensive among the additional costs of purchasing a house.
The new Legislative Decree Workcurrently under discussion in the Senate, contains a very important modification proposal precisely with regard to real estate deeds and which directly affects the information which concern the commissions paid to brokers. We are, in fact, talking about the sum that is paid to the real estate agent who handled the sale.

Among the amendments to the Legislative Decree. work that which most closely concerns notarial deeds for real estate purchases provides the elimination of the obligation to indicate the amount of sum paid to the real estate agent.

This is a modification that goes to simplify one of the obligations of legislative decree no. 223/2006 and this is a change that is particularly requested and well received by operators in the sector. A rule considered unfair, given that among the professional figures involved in the sale of a house, mediators are currently the only ones who must declare in the deed what they have acquired in compensation.
Until now, in fact, they had to be reported in the deed the amount of the commission and the detail on the methods of payment. With the approval of the new decree it will only be necessary to enter the invoice number.
The president of Fiaip, Gian Battista Baccarina, talks about a change that brings with it a double objective: protection from the privacy for all parties involved, but even greater freedom of contract economic relationship between the client and the real estate agent.
In any case, transparency will be guaranteed and yes will avoid l’tax evasion which is the point that worries us the most. All thanks to the obligation to electronic invoicing definitively introduced in 2024 which allows the chain of payments made for the mediation service to be reconstructed.
The same amendment confirms the right to 19% tax deduction on expenses incurred for commissions paid to agents up to a maximum of one thousand euros. This is a benefit that guarantees a small financial support to buyers who turn to a mediator when purchasing a home.
