Member of the Prabowo-Gibran Defense Team, Hotman Paris Hutapea irritated because his questions were not answered by the experts presented by the 01 Anies Baswedan-Muhaimin Iskandar camp (AMEN), Managing Director Political Economy and Policy Studies (PEPS) Anthony Budiawan.
In the presidential election dispute hearing which was held at the Constitutional Court (MK) building, Jakarta, Monday (1/4), Hotman initially admitted that he was confused by the statement given by Budiawan.
Hotman assessed that Budiawan’s statement exceeded that of legal experts. In fact, his capacity as an economist. He then asked Budiawan a question, who according to him had accused President Joko Widodo (Jokowi) of committing a criminal act of corruption, violating the APBN Law, and not asking for DPR approval in distributing social assistance.
This was then used as the basis for the Constitutional Court to annul the results of the 2024 presidential election and request that a re-vote be held.
“The question is whether the Constitutional Court has the authority in its decision to state that because Jokowi violated the Corruption Law, violated the social assistance law, the election must be canceled and repeated,” said Hotman.
Meanwhile, he said, neither Jokowi, the DPR, nor the ministers were parties to the dispute in the presidential election dispute trial this time.
“Can the MK state that this is the reason why the election must be cancelled? Thank you,” asked Hotman.
However, Budiawan did not answer Hotman’s question. Budiawan only said that there were many crimes that had not yet been investigated.
“Will this be investigated later? Yes, we will hand it over to those who feel it is interested. Will the violations of the law, alleged violations of this law, be followed up to investigate criminally? But in this case, this violation is for the benefit of social assistance and for the benefit of election,” said Budiawan.
Budiawan emphasized that the presidential election dispute trial was held so that the Constitutional Court would assess whether or not the social assistance disbursed ahead of the 2024 election was legal.
“Social assistance is clear, as I explained, it is for the victory of the candidate pair,” he said.
Hotman then spoke to Chief Constitutional Justice Suhartoyo that Budiawan had not answered his question.
“Assembly, Hotman Paris’s question has not been answered. Can the applicant’s petition accusing Jokowi of corruption be used by the Constitutional Court as a basis for canceling the election just because of his expertise? Please, the assembly has not answered it, please answer it,” said Hotman.

Suhartoyo also asked Budiawan whether he would answer Hotman’s question. However, Budiawan handed it over to the Court. Chief Justice Suhartoyo also nudged Hotman not to force the expert to answer.
“Don’t be too enthusiastic,” Suhartoyo admonished Hotman.
“Experts are also not forced to answer, let alone what they want,” he added.
Hotman asked Budiawan to be consistent with the statements made before the court, not just empty talk.
“Yes, but whether that part falls under the MK’s authority is not answered, it is up to you,” said Suhartoyo.
“As an expert, he should be consistent with his answers, not just talk nonsense,” answered Hotman.
“You can’t force it like that,” said Suhartoyo.
